Regulations 

§ 0 The cultivation of psilocybin mushrooms is prohibited by law in Poland - by purchasing products from us, you declare that you will not use them for legally prohibited acts.

§ 1 

Definitions 

For the purposes of these regulations, the following meanings of the following terms are adopted: 

  1. Buyer - a natural person with full legal capacity, a legal person or a legal entity without legal personality, 
  1. Consumer - a natural person, entering into a contract with the Seller not related to  
    with directly with its business or professional activities, 
  2. PoP-Consumer rights trader- a person with certain consumer rights according to Article 556.2 Civil Code. 
  3. Store - online store operating at https://goldenteacher.pl/
  4. Seller- Anna Matyjak ME; Łączna nr 9 44-350 NIP: 647-25-91-371. 

§ 2 

Preliminary provisions 

  1. Through the Store, the Seller provides the Buyer with the opportunity to conclude a contract for the supply of products described on the pages of the Store. 
  2. Regulations define the terms and conditions of use of the Store, as well as the rights and obligations of the Seller and Buyers. 
  3. In order to use the Store, it is not necessary for the computer or other device of the Buyer to meet special technical conditions. Sufficient are: 
  4. Internet access, 
  5. Standard operating system, 
  6. Standard web browser, 
  7. Having an active e-mail address. 
  8. The buyer cannot purchase from the Store anonymously or under a pseudonym. 
  1. It is forbidden during the use of the Store to provide content of an unlawful nature, in particular by sending such content via forms available in the Store.
  2. The buyer undertakes to strictly adhere to the instructions and not to use the products available in the store contrary to the description and contrary to the instructions.
  3. All product prices listed on the Store's pages are gross prices. 

§ 3 

Services provided electronically 

  1. Through the Store, the Seller provides electronic services to the Buyer. 
  2. The basic service provided electronically to the Buyer by the Seller is to enable the Buyer to place an order in the Store leading to the conclusion of a contract with the Seller. Placing an order is possible without having an account in the Store. 
  3. Services are provided electronically to the Buyer free of charge. However, the contracts of sale, the contract of delivery through the Store are chargeable.
  4. In order to ensure the security of the Buyer and the transfer of data in connection with the use of the Store, the Seller takes technical and organizational measures appropriate to the degree of security risk of the services provided, in particular, measures to prevent the acquisition and modification of personal data by unauthorized persons. 
  5. The Seller takes measures to ensure the full proper functioning of the Store. The Buyer should inform the Seller about any irregularities or interruptions in the functioning of the Store. 
  6. Any complaints related to the functioning of the Store, the Buyer may submit via e-mail to the e-mail address contact MAŁPA goldentecher.pl In a complaint, the Buyer should provide his name and surname, mailing address, as well as the type and date of occurrence of irregularities related to the functioning of the Store. The Seller will consider all complaints within 14 days of receipt of the complaint and will inform the Customer of its resolution to the e-mail address of the complainant. 

§ 4 

Placing an order in the store 

  1. Placing an order is done by filling out the order form. In the form, it is necessary to provide the data necessary to complete the order. At the stage of placing the order, the method of payment for the order is also selected. Placing an order is conditional on accepting the Rules and Regulations, with which the Buyer should first become familiar. If there is any doubt about the Regulations, the Buyer may contact the Seller. 
  1. After clicking on the order finalization button, the buyer will be redirected to the payment gateway paynow, according to the selected payment method. After the payment is successfully made, the Buyer will be redirected back to the Shop page with the order confirmation. At this moment, the contract is considered to be concluded between the Buyer and the Seller. Confirmation of the conclusion of the contract will be sent to the Buyer at the e-mail address provided in the order form. 
  2. Upon confirmation of the order, a contract between the Buyer and the Seller is concluded. 
  3. In the order form, the Buyer must provide true personal information. The Buyer is liable for providing false personal data. The Seller reserves the right to suspend the execution of the order in a situation where the Buyer has provided false data or where the data raises reasonable doubts of the Seller as to its accuracy. In such a case, the Buyer will be informed by phone or e-mail about the doubts of the Seller. In such a situation, the Buyer shall have the right to explain any circumstances related to the verification of the veracity of the data provided. In the absence of data allowing the Seller to undertake contact with the Buyer, the Seller will provide any explanations after the Buyer has undertaken contact. 
  1. The Buyer declares that all data provided by him in the order form are true, while the Seller is not obliged to verify their veracity and correctness, although he has such a right in accordance with paragraph 4 above. 
  2. The buyer also declares that he has familiarized himself with the product description, as well as the instructions available on the product page, and will not use them against recommendations. 
  3. The buyer is aware that the use of products not in accordance with the recommendations may give rise to legal consequences and expose him to criminal liability. 

§5 

Products

  1. The products available within the Store are described on the products sub-page.  
  2. The services provided by the Seller are focused on providing the Buyer's products. Their nature is purely hobbyist and should be used in accordance with the instructions and intended use
  3. The seller is not responsible for the consequences of incorrect or illegal use of products. 
  4. Acceptance of the Terms and Conditions is a condition of order processing. 

§ 6 

Delivery and payment 

  1. Available methods of payment for an order are described on the pages of the Store and are presented to the Buyer at the stage of order placement. 
  2. The order will be dispatched to the buyer after payment confirmation  

§ 7 

Electronic products 

  1. Fulfillment of an order involving an electronic product such as an ebook, etc., is accomplished by sending a message to the e-mail address provided by the Buyer in the order form containing instructions for downloading or accessing the purchased electronic product. 
  2. Upon dispatch of the message referred to in paragraph 1 above, the digital content covered by the order shall be deemed to have been delivered in full to the Buyer. 
  3. With regard to electronic products, there is no right to withdraw from the contract and return the product in accordance with the provisions of §8.  

§ 8 

Intellectual property rights 

  1. The Seller hereby instructs the Buyer that the contents of the Store and electronic products are protected by copyright. 
  2. Property and personal copyrights as to the products and content distributed through the Service belong to the Seller.  
  3. Unlawful distribution of content or materials referred to in paragraph 1 above may result in civil or criminal liability. 

§ 9 

Cancellation of Consumer or PoP contract

  1. A consumer and PoP who has concluded a remote contract with the Seller has the right to withdraw from the contract without giving any reason within 14 days from the date of conclusion of the contract (in the case of a contract for the supply of digital content). 
  2. The right of withdrawal does not apply to contracts for the supply of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the Consumer and PoPa before the expiry of the deadline for withdrawal and after the Seller has informed him of the loss of the right of withdrawal. 
  3. The right of withdrawal also does not apply to products prepared on special order of the PoP Consumer and according to personal preferences.  
  4. The moment of commencement of performance is the delivery of an email to the Buyer with instructions to access the digital content. 
  5. To withdraw from the contract, the Consumer or PoP must inform the Seller of his decision to withdraw from the contract by an unequivocal statement - for example, a letter sent by mail, fax or e-mail. 
  6. In order to comply with the withdrawal period, it is sufficient for the Consumer or PoP to send information on the exercise of the Consumer's or PoP's right of withdrawal before the expiration of the withdrawal period. 

§ 10 

Liability for defects 

  1. The Seller is obliged to provide the Buyer with a product free of defects. 
  2. The seller is liable to the buyer if the sold product has a physical or legal defect (warranty for defects). 
  3. If the Buyer finds a defect, he should inform the Seller about it, specifying at the same time his claim related to the found defect or making a statement to that effect. 
  4. The Buyer may contact the Seller both by regular mail and by e-mail. 
  5. The Seller will respond to the complaint submitted by the Buyer within 14 days from the date of delivery of the complaint to him by such means of communication, using which the complaint was submitted. 

§ 11 

Personal data and cookies 

  1. The administrator of the Buyer's personal data is the Seller. 
  2. The Buyer's personal data is processed for the purpose of order processing, user account and possible defense, investigation or establishment of claims related to contracts concluded through the Store.

§ 12 

Out-of-court ways of dealing with complaints and redress of grievances 

  1. The seller agrees to submit any disputes arising in connection with the concluded contracts to mediation. Details will be determined by the parties to the conflict. 
  2. The Consumer or PoP has the opportunity to use out-of-court means of handling complaints and claims. Among other things, the Consumer or PoP has the opportunity to: 
  3. to apply to a permanent amicable consumer court to resolve a dispute arising from the contract, 
  4. Apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings for an amicable settlement of the dispute between the Buyer and the Seller, 
  5. Use the assistance of the district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection. 
  6. For more detailed information on out-of-court ways of handling complaints and claims, the Consumer or PoP can look at the website http://polubowne.uokik.gov.pl
  7. The consumer or PoP can also use the ODR platform, which is available at. http://ec.europa.eu/consumers/odr. The platform serves to resolve disputes between consumers and businesses seeking out-of-court settlement of disputes regarding contractual obligations arising from an online sales contract or service contract. 

§ 13 

Final provisions 

  1. The Seller reserves the right to introduce and cancel offers, promotions and to change prices in the Store without prejudice to the Buyer's acquired rights, including, in particular, the terms of contracts concluded before the change. 
  2. Any disputes related to contracts concluded through the Store will be considered by a Polish common court with jurisdiction over the Seller's permanent place of business. This provision does not apply to Consumers and PoPs, in the case of which the jurisdiction and jurisdiction of the court are considered on general principles. 
  3. The Seller reserves the right to make changes to the Regulations. Contracts entered into before the amendments to the Terms and Conditions shall be governed by the Terms and Conditions in effect on the date of the contract. 
  4. These Regulations are effective as of 08.07.2021.
